Storm Water Discharges Associated with Construction Activities (General Permits GAR 100001, 100002, 100003)

NPDES General Construction Permit Changes

Effective August 1st, 2008, the Georgia Environmental Protection Division (EPD) is re-issued the NPDES General Permits GAR100001, GAR100002, and GAR100003 for Storm Water Discharges Associated with Construction Activity.  The following is a summary of the major changes to the new permits.

What Changes?

  • Sites that discharge storm water into an Impaired Stream Segment, or within 1 linear mile upstream of and within the same watershed as the Impaired Stream Segment, as listed on Georgia’s 2008 and subsequent 305(b)/303(d) List for the criteria of “Bio F” and/or “Bio M”, must satisfy the additional requirements of Part III.C of the new permits. Part III.C will not apply to construction activities for Stand Alone and Common Development projects if the NOI is submitted within 90 days of the effective date of the permits and will not be applicable to infrastructure projects if the NOI is submitted prior to January 1, 2009.
  • Total disturbed area for construction sites will be limited to no more than 50 acres at one time without prior written authorization from the appropriate EPD District Office.
  • For Common Development projects with unsold/undeveloped lots, the Primary Permittee may submit a Notice of Termination only after all construction activities have ceased for a minimum of 90 days, final stabilization has been achieved, all secondary permittees have submitted NOT’s, and the site is in compliance with the permit. After submitting the NOT, the primary permittee shall notify the legal title holder or the purchaser of any remaining undeveloped lot(s) that they will become tertiary permittees under the permit and are responsible for implementing the requirements of the permit.

Important: All existing sites that have not yet submitted their Notice of Termination under the old permits are required to submit the new Notice of Intent within 60 days of the effective date of the new permits.
